La legítima defensa en la legislación ecuatoriana

Abstract

La legítima defensa existe desde tiempos inmemorables, desde cuando el hombre de la selva por instinto de conservación se defendía de las fieras que lo atacaban; respondiendo en una reacción natural, propia y necesaria para repeler cualquier agresión, y no se diga cuando el ataque aleve viene de un ser humano que piensa para actuar y por supuesto para atacar; de ahí es que dentro del campo jurídico, la legítima defensa se fundamenta en un criterio objetivo, por considerarse que es una institución indispensable para la conservación del ser humano; pues la doctrina ha considerado que el fundamento ha de tener como base el interés preponderante de la salvaguarda de los bienes jurídicamente protegidos.
