Abstract: El Derecho a la estabilidad y la sucesiva renovación del contrato de servicios ocasionales en el sector público, es un tema actual de importancia, pues es indispensable, regular y coordinar el ingreso de los servidores públicos a las instituciones públicas, a fin de que no se vulnere tanto el derecho a la igualdad como el derecho a la estabilidad, ya que son derechos fundamentales que consagra y tutela la Constitución de la República del Ecuador del año 2008. En la actualidad la administración pública de nuestro país ha adoptado como práctica común, la sucesiva renovación del contrato de servicios ocasionales, muchas veces sin que la necesidad institucional se encuentre determinada técnicamente, vulnerando de esta manera la esencia de la ocasionalidad de este tipo de contratación. Por lo que este hecho ha producido que varios servidores públicos contratados bajo esta modalidad acudan a los tribunales a que se les reconozca su derecho a la estabilidad y permanencia que consagra la Constitución vigente; produciendo de esta manera u otra una desigualdad frente a los empleados públicos que entran al servicio público a través de un concurso de meritos y oposición que legalmente se requiere para acceder a un puesto en el sector público. Finalmente, no se puede olvidar que la Ley Orgánica del Sector Público, publicada el 06 de Octubre del 2010, Registro Oficial No. 294-Segundo Suplemento, prevé ciertos plazos de duración, ya que toda vez que sea para atender necesidades permanentes, corresponde crear la partida en el distributivo de remuneraciones y convocar a concurso de méritos y oposición para seleccionar a quien obtenga la mayor calificación dentro de las evaluaciones correspondientes al puesto, dando paso de esta manera a que se goce de estabilidad en el puesto de manera legítima.
The right to stability and the successive renewal of the contract for occasional services in the public sector, it is a current issue of importance, as it is indispensable, regular and coordinate the entry of public servants into public institutions, so that they do not both the right to equality and the right to stability are violated, since they are fundamental rights enshrined and protected by the Constitution of the Republic of Ecuador of the year 2008. At present the public administration of our country has adopted as a practice common, the successive renewal of the contract for occasional services, many times without the institutional need is determined technically, violating this way the essence of the occasionality of this type of contracting. So this fact has produced that several public servants hired under this modality go to the courts to be recognized their right to stability and permanence that enshrines the Current Constitution; producing in this way or another an inequality in front of the public employees who enter the public service through a merit contest and opposition that is legally required to access a position in the public sector. Finally, it can not be forgotten that the Organic Law of the Public Sector, published on 06 October 2010, Official Register No. 294-Second Supplement, provides certain deadlines for duration, since whenever it is to meet permanent needs, it is necessary to create the departure in the distribution of remunerations and call for merit and opposition to select who gets the highest score within the evaluations corresponding to the position, giving way in this way to enjoy stability in the put in a legitimate way.
