Abstract: El tema que se desarrolla a continuación busca conocer y entender de qué modo, los fideicomisos de titularización de flujos futuros pueden ser un mecanismo adecuado para potencializar el financiamiento de las compañías dentro de nuestro país. Empezando por la comprensión de los componentes económicos básicos dentro de la relación económico jurídica de la negociación dentro de los diferentes tipos de mercados, siguiendo por la comprensión y análisis del origen del fideicomiso. Conocido de larga data por el derecho romano, en sus diferentes modalidades como la de fiducia cum creditore3, o fiducia cum amigo4, así como por el derecho anglosajón, en el cual nace como una herencia del sistema legal inglés, con el nombre dado por los ingleses: “trust”5; de éstos (de los fideicomisos romanos y del trust) se inspira el contrato de fiducia del régimen jurídico latinoamericano6, el cual a pesar de ser una institución relativamente nueva en nuestra legislación, la cual por su juventud supone un gran desconocimiento sobre el régimen aplicable a este negocio fiduciario se encuentra practicándose ávidamente por los comerciantes e inversionistas ecuatorianos
The theme that develops below seeks to know and understand in what way, the Trusts securitization of future flows can be an appropriate mechanism for potentialize the financing of companies within our country. Starting with the Understanding of the basic economic components within the economic relationship legal framework for negotiation within different types of markets, following the understanding and analysis of the origin of the trust.
