Abstract: La dación de órganos y tejidos humanos para la realización de trasplantes ha sido una de las mayores preocupaciones de la humanidad. Desde épocas bíblicas ya hay los primeros indicios para reemplazar órganos dañados por otros en buen estado; mas, con el avance de la tecnología médica contemporánea, este procedimiento se ha hecho realidad, pero concomitantemente con este logro medico de gran trascendencia, se ha desencadenado una problemática respecto de la obtención de dichos órganos, cuyo acto desde siempre se ha considerado como altruista y voluntario, por lo que no forma parte de un negocio. Es así que ha sido protegido por los distintos ordenamientos jurídicos del mundo. Así pues, difícilmente se puede considerar un negocio jurídico a la dación de un órgano o tejido humano en tanto no existe el complemento de la segunda voluntad, es decir del receptor para configurarlo jurídicamente como un negocio. En este sentido éste es un acto que no tiene denominación en el derecho civil, pero que adquiere gran incidencia en el objetivo de salvar vidas; razón por la cual no se le puede asignar contraprestación monetaria De todas formas, es necesario saber que existen diferencias entre la dación y la donación. La segunda de éstas es una figura jurídica del derecho civil en la cual dos voluntades se armonizan y pactan la entrega y la recepción del órgano o tejido humano con el fin de salvar una vida. En este acto si se conoce al receptor, por lo tanto puede crearse un interés particular entre los participantes. Finalmente, la forma en la que se obtenga el órgano que salvará vidas, puede ser cualquiera de estas dos figuras. Por lo tanto, y para evitar que se comercialice con este acto, nuestro ordenamiento jurídico interno ha creado una ley regulatoria. Sin embargo, y a pesar de que el objetivo es propiciar la voluntariedad de los donantes, incorporar imposiciones en esta ley puede estar provocando el efecto contrario. Obligar a que alguien sea donador causaría molestias, sobre todo si para ordenar su documentación de donante debe acudir hasta el Registro Civil para presentar su oposición a esta imposición
The donation of human organs and tissues for the realization of transplants has been one of the greatest concerns of humanity.
