El trabajo infantil y su influencia en el desarrollo integral de los niños, niñas y adolescentes dentro del punto de vista jurídico – social en Ecuador: Cantón Colta

Abstract

El trabajo infantil es un problema que nació hace varias décadas, no solo a nivel nacional sino en muchos otros países. Al término “trabajo infantil” se lo puede definir como todo trabajo que priva a los niños de su niñez, su potencial y su dignidad, y que es perjudicial para su desarrollo físico y psicológico. Existen diversas formas de trabajo realizadas por niños. Algunas son difíciles, exigentes, y peligrosas, pero cualquiera que sea puede llegar a ser perjudicial para el bienestar físico, mental o moral del niño, interfiere con su escolarización puesto que les priva de la posibilidad de asistir a clases, les obliga a abandonar la escuela de forma prematura, o les exige combinar el estudio con un trabajo pesado y que insume mucho tiempo. Estos resultados tienen que ser revertidos por los diversos órganos estatales, pues contando tanto con la normativa legal nacional vigente, y también con los tratados internacionales, se espera que se erradique el trabajo infantil, haciendo efectiva la aplicación de las leyes. La comunidad internacional ha condenado cualquier tipo de explotación laboral a los niños, niñas y adolescentes, y se ha esforzado para fortalecer la normativa legal internacional, mediante la creación de varias leyes y tratados internacionales, esto de una u otra forma ha colaborado para la disminución del índice de niños, niñas y adolescentes trabajadores, pero aún queda mucho trabajo por hacer, y poder difundir los problemas que trae consigo que un niño, niña o adolescente trabaje. Este trabajo se concentra en un pequeño cantón de la provincia de Chimborazo, llamado Colta, y la población de estudio será de 9.320 niñas, niños y adolecentes que oscilan entre los 5 y 15 años de edad, se analizará las causas y consecuencias del trabajo infantil, utilizando instrumentos como por ejemplo entrevistas y cuadros estadísticos.

Child labor is a problem that was born several decades ago, not only at the national level but in many other countries. The term "child labor" can be defined as all work that deprives children of their childhood, their potential and their dignity, and that is detrimental to their physical and psychological development. There are different forms of work carried out by children. Some are difficult, demanding, and dangerous, but whatever may be harmful to the physical, mental or moral well-being of the child, it interferes with their schooling since it deprives them of the possibility of attending classes, forcing them to abandon school prematurely, or requires them to combine the study with a heavy and time-consuming work. These results have to be reversed by the various state bodies, because counting both the current national legal regulations, and also international treaties, it is expected that child labor will be eradicated, effectively enforcing the laws. The international community has condemned any type of labor exploitation to children and adolescents, and has endeavored to strengthen international legal regulations, through the creation of several international laws and treaties, this in one way or another has contributed to the decrease of the index of working children and adolescents, but there is still a lot of work to be done, and to be able to spread the problems that a child or adolescent has to work with. This work is concentrated in a small canton of the province of Chimborazo, called Colta, and the study population will be 9,320 girls, boys and adolescents ranging between 5 and 15 years of age, the causes and consequences of child labor will be analyzed , using instruments such as interviews and statistical tables.
