Abstract: El Ecuador cuenta con una deficiente regulación en la declaratoria de los Estados de Excepción. Dicha declaratoria es de relevante importancia para la sociedad, para las instituciones del Estado y sus autoridades, por el hecho que al suceder emergencias dentro de un Estado, esta declaratoria suspende o limita el ejercicio de ciertos derechos de la ciudadanía. Siendo un tema delicado por cuanto surge esta restricción de derechos ciudadanos, es indispensable analizar la legislación que regula los estados de excepción y proponer reformas jurídicas que viabilicen una mayor seguridad jurídica para el Estado. Para esto, se realiza un análisis de la Constitución Política de Chile y su Ley Orgánica Constitucional de los Estados de Excepción, para definir si es pertinente adaptar ciertos preceptos jurídicos a la legislación ecuatoriana en cuanto a los Estados de Excepción confiere. Es por esto, que el presente trabajo considera desarrollar al Estado de Excepción desde su origen, la doctrina que lo sustenta, los principios en el cuál debe enmarcarse, los conceptos sobre las causales para la declaratoria de excepción, la enunciación y desarrollo de los derechos susceptibles a ser limitados o suspendidos durante la vigencia de los estados excepcionales en el Ecuador, además de indagar en la legislación chilena y adoptar los preceptos favorables y aplicarlos a la legislación ecuatoriana.
Ecuador has a deficient regulation in the declaration of the States of Exception. This declaration is of significant importance for society, for the State institutions and their authorities, due to the fact that when emergencies occur within of a State, this declaration suspends or limits the exercise of certain rights of the citizenship. Being a sensitive issue because this restriction of citizenship rights arises, it is indispensable to analyze the legislation that regulates states of exception and propose legal reforms that make greater legal security for the State possible. For this, it performs an analysis of the Political Constitution of Chile and its Constitutional Organic Law of States of Exception, to define if it is pertinent to adapt certain legal precepts to Ecuadorian legislation regarding the States of Exception confers. For this reason, the present work considers developing the State of Exception from its origin, the doctrine that sustains it, the principles in which it must be framed, the concepts on the grounds for the declaration of exception, the enunciation and development of the rights that may be limited or suspended during the term of the states exceptional in Ecuador, in addition to investigating Chilean legislation and adopting the favorable precepts and apply them to Ecuadorian legislation.
