Abstract: Dentro de la etapa de admisibilidad de medios probatorios, se presenta una colisión entre el derecho constitucional de defensa versus el principio de economía procesal, y la constitucionalidad y legalidad en la oferta probatoria, confrontación ante la que el proceso regula un sistema de parámetros de admisibilidad, cuyo rol es constituirse en filtros a través de los que la oferta probatoria de las partes procesales sea expuesta a un examen objetivo que extraiga los medios probatorios que son admisibles -y por ende aptos para practicarse- de aquellos que no lo son; todo ello, con el fin de garantizar la no violación de los derechos de los litigantes y generar que la actividad probatoria sea eficaz. Sin embargo, la regulación que el COGEP ha establecido sobre la admisibilidad de medios probatorios, no estructura adecuada e integralmente estos parámetros, ni tampoco define varios de ellos de manera acertada, por lo que es una regulación inexacta. Motivo por el que la presente investigación pretende proponer que el sistema de admisibilidad existente sea potenciado mediante: el uso de principios como la máxima pro probatione, el develamiento de criterios de admisibilidad implícitos (oportunidad y disponibilidad), la aplicación jerarquizada de los parámetros de admisibilidad por parte del juzgador, y una propuesta procedimental de esta fase, que en suma podrían permitir que esta etapa cumpla con su finalidad procesal, sin recurrir necesariamente a una reforma legal.
Description: During the stage of evidence admissibility, there is a collision between the constitutional right of defence versus the principle of procedural economy and the constitutionality and legality in the evidentiary offer. Given this confrontation, the process regulates a system of admissibility parameters, whose role is to act as filters through which the evidentiary offer of the procedural parties is subject of examination so that the evidence that is admissible -and therefore suitable for practice- is extracted from that which is not.; all this, in order to guarantee the non-violation of the litigants rights and to ensure that the evidentiary activity is effective. However, the regulations established by COGEP in terms of the evidence admissibility do not structure properly and completely the parameters to use and do not define many of them, either, resulting in an inaccurate regulation. The current investigation aims to propose that the existing admissibility system be improved by: the use of principles such as the maximum pro probatione, the unveiling of implicit admissibility criteria (opportunity and availability) and the hierarchical application of the admissibility parameters by the judge; a procedural proposal, which in short would allow this stage to fulfil the intended procedural, without the need of resorting to legal reforms
