Abstract: La exigencia de investigación en los centros de educación superior, es fundamental en el desarrollo de los educandos; esto se plasma en el presente trabajo. Partiendo de los problemas sociales que se han generado, y que desembocan en problemas más grandes que tienen que ver con la seguridad interna, se ha observado un problema que incluye al estado a través de las instituciones de la fuerza pública con el deber de protección de las personas y garantías de los derechos, y la sociedad exigiendo el cumplimiento cabal de sus derechos. Problema que nos lleva a reflexionar sobre el derecho probatorio a la luz de la corte interamericana de derechos humanos en los casos de tortura y que sean aplicables en Ecuador. Así también en consideración que en el Ecuador se ha dictado la primera sentencia condenatoria por el delito de tortura bajo las reglas del Código Orgánico Integral Penal aprobado en el año 2014, requiere un análisis jurídico-académico, considerando además los estándares establecidos por la Corte Interamericana de Derechos Humanos y la forma en cómo se valora la prueba, desde la idea del derecho procesal contemporáneo. Análisis que nos lleva a entender de lo formalistas que podemos llegar a ser, so pretexto del cuidado de derechos en el sistema procesal, y el ámbito probatorio; por lo que se ha llegado a concluir que en la sentencia objeto de análisis, existe una errónea apreciación de la prueba, esto a la luz de los estándares establecidos por la Corte Interamericana de Derechos Humanos.
Description: The requirement of research in higher education centers is fundamental in the development of students; This is reflected in the present work. Starting from the social problems that have been generated, and that lead to bigger problems that have to do with internal security, a problem has been detected that includes the state through the institutions of the public force with the duty of protection of people and rights guarantees, and society demanding full compliance with their rights. Problem that leads us to a reflection on the probative right in the light of the inter-American court of human rights in cases of torture and that are applicable in Ecuador. Also in consideration that in Ecuador the first conviction for the crime of torture has been issued under the rules of the Comprehensive Organic Criminal Code approved in 2014, requires a legal-academic analysis, in addition to the criteria established by the Inter-American Court of Human Rights and the way in which the evidence is valued, from the idea of contemporary procedural law. Analysis that leads us to an understanding of what formalists we can become, so the pretext of the care of rights in the procedural system, and the probative scope; Therefore, a conclusion has been reached that in the judgment under analysis, there is a lack of appreciation of the evidence, this in light of those established by the Inter-American Court of Human Rights
