dc.descriptionIn Ecuador, we find that the commercial sector that most uses this contract of industrial pledge is the automotive sector, more specifically in financing, due to its high demand in the main cities. According to the Association of Automotive Companies of Ecuador AEADE (2018) alone in the year 2018 calculated until the month of August have been sold 10,762 vehicles (units), of which 31% of vehicle sales have been through financing. When a natural or legal person wants to access the purchase of a vehicle through financing, in any concessionaire, the most used option, and recommended, is the credit through an open industrial pledge issued by the financial entities, a title that is used for not contravening the Monetary norms and regulations of the Superintendency of Banks, also because it is a contract that has a registration obligation, is a pledge that to be an obligation between the parties, it must be registered in the Commercial Registry. For this reason, being the title that is currently issued to guarantee a vehicle credit are: the Open Industrial Garments; naturally we can define that, this title is the most required to be executed by judicial means, in case of breach of the obligation, this has generated a serious accumulation of causes in the Civil and Commercial Judicial Units, mainly in Quito, where it is a of the cities where the automotive trade is largely concentrated. Although the General Organic Code of Processes COGEP promotes the Process of Execution as the ideal for these titles to be practical and apparently without delay, the processes do not end in the desired times, as most industrial garments are imposed on goods that have a high level of depreciation, the greatest harm that the parties have is that there is no quick and effective recovery of their past due obligation, in the shortest possible time, and that the good during the process is depreciating in the hands of the judicial depositories they do not have due diligence in protecting these assets. xi The investigation was carried out by means of a data collection in the processes of execution of the industrial garments, developed in the Civil and Mercantile Judicial Units of the Iñaquito parish of Quito. The main conclusion of this study is to determine that the execution process is not the most efficient, and that it presents several administrative problems, which entails an economic loss for both the Pledgee Debtor and the Pledgee Creditor.es
dc.description.abstractEn el Ecuador, encontramos que el sector comercial que más utiliza este contrato de prenda industrial es el sector automotriz, más concretamente en el financiamiento, por su gran demanda en las principales ciudades. Según la Asociación de Empresas Automotrices del Ecuador AEADE (2018) solo en el año 2018 calculado hasta el mes de agosto se han vendido 10.762 vehículos (unidades), de los cuales el 31% de las ventas de vehículos han sido mediante financiamiento. Cuando una persona natural o jurídica quiere acceder a la compra de un vehículo mediante financiamiento, en cualquier concesionario, la opción mas usada, y recomendada, es el crédito mediante prenda industrial Abierta emitido por las entidades financieras, título que se usa por no contravenir las normas y regulaciones monetarias de la Superintendencia de Bancos, además porque es un contrato que tiene una obligación registral, es una prenda que para que sea una obligación entre las partes, tiene que inscribirse en el Registro Mercantil. Por está razón, al ser el título que actualmente más se emite para garantizar un crédito de vehículos son: las Prendas Industriales Abiertas; naturalmente podemos definir que, este título es el más requerido para ser ejecutado por la vía judicial, en caso de incumplimiento de la obligación, esto ha generado una grabe acumulación de causas en las Unidades Judiciales Civiles y Mercantiles, principalmente en Quito, donde es una de las ciudades donde se encuentran concentrados en gran medida el comercio automotriz. Aunque el Código Orgánico General de Procesos COGEP promociona al Proceso de Ejecución como el ideal para estos títulos por ser práctico y aparentemente sin dilaciones, los procesos no terminan en los tiempos deseados, como la mayoría de prendas industriales está impuesta sobre bienes que tienen un alto nivel de depreciación, el mayor perjuicio que tienen las partes es que no hay la recuperación rápida y efectiva de su obligación vencida, en el ix menor tiempo posible, y, que el bien mientras dura el proceso, esté depreciándose en manos de los depositarios judiciales que no tienen las debida diligencia en precautelar estos bienes. La investigación se realizó mediante un levantamiento de datos en los procesos de ejecución de las prendas industriales, desarrolladas en las Unidades Judiciales Civiles y Mercantiles de la parroquia Iñaquito ciudad de Quito. La principal conclusión de este estudio permite determinar que el proceso de ejecución no es el mas eficiente, y que presenta diversas problemáticas sobre todo administrativas, lo que conlleva un perjuicio económico tanto para el Deudor Prendario como para el Acreedor Prendario.es
