Abstract: Este trabajo de grado denominado “el silencio administrativo positivo, su debido proceso ante la jurisdicción contenciosa”, elabora un estudio sobre la normativa procesal ecuatoriana en sede contenciosa, haciendo énfasis en un tratamiento diferenciado de la institución, del silencio administrativo positivo, en lo tributario y administrativo, sin justificación jurídica que sustente dicha actuación legislativa. El primero se lo presenta como una acción de impugnación en trámite ordinario y con oportunidad para ejercerla en sesenta días, mientras que en lo administrativo con la vigencia de las reformas al Código Orgánico General de Procesos, se plantea como una solicitud de ejecución dentro del Capítulo II sin especificación del tiempo para su presentación. Se iniciara con algunas corrientes y teorías a fin de que exista un sustento, especificando los principios rectores como son: los principios de simplificación, uniformidad, eficacia, inmediación, celeridad, economía procesal, congruencia y apego a puro derecho, estableciendo que estos principios son procedentes e indispensables en cualquier proceso especialmente en el administrativo. Se discurre de igual manera la seguridad jurídica, el debido proceso, el derecho a la defensa y el derecho a la petición posiciones filosóficas y opiniones de tratadistas que aportan con su criterio para reafirmar la propuesta de teorías que la sustentan su concepción actual a la luz de los principios jurídicos y los fines públicos en el marco del Estado constitucional de derechos y justicia.
Description: The current graduation work called positive administrative silence and its process in the contentious jurisdiction that will be presented carries out a study about the Ecuadorian procedural norm in the contentious headquarters, emphasizing a differentiated treatment of the institution about the positive administrative silence regarding to the tributary and administrative without any legal justification that supports this legislative action, since the tributary aspect is presented as an impugnation action in an ordinary procedure to be accomplished within 60 days, while the administrative aspect is under the validity of reforms of the Código Orgánico General de Procesos. This is proposed an implementation inquiry in Chapter II without any specification of time for its proposition. The research starts with some views and theories in order to create a support that specifies the leading principies such as simplification, uniformity, efficiency, immediacy, haste procedural economy, congruency and adherence to law establishing that these principies are precedent and indispensable in any process, especially in the administrative one. The legal security, due process, right to defense, right to petition, philosophical positions, and views of authors that support with their criteria to reaffirm the proposal to reform the Código Orgánico General de Procesos are developed. O finish, different views and theories supporting the research, the current conception in front of legal principies and public purposes within the framework of the Constitutional State of rights and justice are analized.
