Abstract: De la investigación realizada se desprende que la implicación más importante que genera la vigencia de la Ley del Sistema Nacional de Registro de Datos en cuanto se refiere al tema del derecho a la intimidad, es la imposibilidad actual que el Estado ecuatoriano mantiene para garantizar de manera adecuada la confidencialidad y seguridad de la información personal de los ciudadanos que maneja en virtud del cumplimiento de la referida normativa. La legislación ecuatoriana no determina de manera conceptualizada las implicaciones jurídicas que acarrea la noción de derecho a la intimidad, lo cual hace factible que se presenten interpretaciones extensivas que pueden vulnerar el cumplimiento de este derecho y fraccionar la estructura social, por cuanto la información y datos en general son capaces de influir decisivamente en la actividad humana según sean empleados. En base a la configuración de un régimen legal que tutele el manejo y el acceso a los datos e información de diferente naturaleza manejados con el carácter de públicos por instituciones del Estado y por entes privados en el Ecuador, lo que se persigue conseguir por parte de la legislatura es garantizar la protección de tal información y datos mediante la vigencia de términos y condiciones establecidos en la ley, con relación a los datos e información en general que pueda afectar la integridad física, moral, operativa y otros aspectos de similar naturaleza relativos a personas naturales y jurídicas, sean estas públicas o privadas.
From the research carried out, it is clear that the most important implication that the Law of the National System of Data Registration generates in terms of the right to privacy is the current impossibility that the Ecuadorian State maintains in order to guarantee adequate confidentiality and security of the personal information of citizens who manage by virtue of compliance with the aforementioned regulations. Ecuadorian legislation does not determine in a conceptualized way the legal implications of the notion of the right to privacy, which makes it possible to present extensive interpretations that may violate the fulfillment of this right and divide the social structure, as information and data in general they are capable of decisively influencing human activity as they are employed. Based on the configuration of a legal regime that protects the management and access to data and information of different nature handled with the character of public by State institutions and by private entities in Ecuador, which is pursued by The legislature is to guarantee the protection of such information and data through the validity of terms and conditions established in the law, in relation to data and information in general that may affect the physical, moral, operational integrity and other aspects of a similar nature related to natural and legal persons, whether public or private.
