dc.descriptionThe Constitution of 2008 introduced a wide range of constitutional guarantees, including the Extraordinary Protection Action, a mechanism widely used since then to review, at a constitutional level, judgments and judicial decisions that have violated constitutional rights. From a first review of the judgments of the Ecuadorian Constitutional Court from 2008 to the 2015, we find that there is a strong presence of the State as petitioner of this guarantee and also as a beneficiary of it. The purpose of the proposed investigation is to study the AEP decisions in which the State is involved, in order to establish which are the main discourses that the Court has developed about the concept of State and its rights.es
dc.description.abstractLa Constitución de 2008 introdujo una amplia gama de garantías constitucionales, entre ellas la Acción Extraordinaria de Protección, AEP mecanismo muy usado desde entonces para revisar, a nivel constitucional, sentencias y autos judiciales que vulneran derechos constitucionales. De una primera revisión de las sentencias de la Corte Constitucional ecuatoriana, desde 2008 hasta el 2015, encontramos que hay una fuerte presencia del Estado como accionante de esta garantía y también como beneficiario de la misma. La investigación propuesta tiene como objetivo estudiar los fallos de AEP en los que está involucrado en el Estado, con el fin de establecer cuáles son los principales discursos que, en torno al concepto de Estado y sus derechos, ha elaborado la Corte.es
