Abstract: | La historia nos muestra que el parlamento históricamente siempre ha otorgado un papel de
importancia en la vida política y desarrollo de un estado.
En Roma, el consejo de ancianos ocupaba un gran poder y autoridad a veces incluso en
oposición al rey.
El parlamento pieza fundamental de una democracia, es el órgano que representa directa o
indirectamente las necesidades del pueblo quien los elige.
Existen dos clases de parlamentos, que se han implementado desde la historia en varios
estados, según sus necesidades: el parlamento unicameral, es cuando se le atribuye todos
los estamentos de legislación y fiscalización a una sola cámara y el parlamento bicameral:
cuando se le atribuye a dos cámaras.
En el devenir histórico el Ecuador ha adoptado los dos sistemas, actualmente continuamos
con el sistema unicameral.
El derecho parlamentario como materia derivada del derecho público, da un avance al
parlamento, en la democratización de su entidad para legislar y fiscalizar como tareas
fundamentales del desarrollo constitucional.
Es así, de la importancia del contenido del derecho parlamentario, expresado como el
conjunto de normas existentes en un esquema jurídico, que regulan las funciones,
estructura, procedimiento y técnicas en la elaboración de la norma, por lo que es
indispensable la técnica en una democracia representativa y sentar bases firmes para los
parlamentarios en la estructuración de la ley. History shows us that parliament historically has always granted a role of importance in the political life and development of a state. In Rome, the council of elders held great power and authority sometimes even in opposition to the king. The parliament, fundamental piece of a democracy, is the body that represents directly or indirectly the needs of the people who choose them. There are two kinds of parliaments, which have been implemented since history in several states, according to their needs: the unicameral parliament, is when it is attributed all the legislature and control bodies to a single chamber and the bicameral parliament: when it is attributed to two cameras. In the historical evolution, Ecuador has adopted the two systems, currently we continue with the unicameral system. Parliamentary law as a matter derived from public law, advances the parliament, in the democratization of its entity to legislate and supervise as tasks fundamentals of constitutional development. It is thus, of the importance of the content of the parliamentary right, expressed as the set of existing rules in a legal scheme, which regulate the functions, structure, procedure and techniques in the development of the standard, so it is indispensable technique in a representative democracy and lay firm foundations for the parliamentarians in the structuring of the law. |
