La rehabilitación integral de las personas privadas de libertad en el centro de rehabilitación social de varones Quito No. 1 – Ex - Penal García Moreno

Abstract

El Sistema Penitenciario Ecuatoriano está atravesando por una grave crisis institucional y funcional, no sólo por la falta de una Rehabilitación Social a las personas privadas de libertad, sino y principalmente por la falta de políticas criminológicas, consecuentes con programas y proyectos de Rehabilitación Integral, hasta ahora inexistentes. Las autoridades por muchos años han hecho caso omiso de las constantes protestas generadas por ésta situación, llegando incluso a producirse motines y muertes de internos por la falta de garantías y servicios en las diferentes Penitenciarias del país. Incluso han sido parte del problema al no generar soluciones efectivas que permitan sobrellevar este gran mal del Estado ecuatoriano. Es por ésta razón que el gobierno actual ha declarado el “Estado de emergencia del Sistema Penitenciario” creando Instituciones como el Ministerio de Justicia y Derechos Humanos encargado de crear planes y proyectos que generen soluciones a los problemas causados. El ex Penal garcía Moreno es un Centro de Rehabilitación Social en el que se refleja la situación emergente señalada anteriormente, se puede observar claramente los problemas como el hacinamiento carcelario, el consumo excesivo de drogas y alcohol por parte de los internos, la falta de trabajo, ecuación, salubridad y condiciones dignas de vida para los internos así como una mala administración institucional. El personal que integra el Centro es deficiente y muy poco profesional y se observa claramente los altos niveles de corrupción y desigualdad social existentes. La promiscuidad llega a niveles alarmantes y los altos niveles de enfermedades respiratorias, estomacales y venéreas permiten observar una falta de atención de las autoridades hacia este sector vulnerable de la población ecuatoriana. vii Todos éstos problemas hacen de éste Centro un lugar que no genere Rehabilitación sino mas bien más violencia y altos niveles de reincidencia, lo que conlleva a un mayor hacinamiento y a un agravamiento de las dificultades mencionadas, así como a un mayor nivel delincuencial en la sociedad. No es fácil generar soluciones a corto o largo plazo, pero es necesario crear programas en los que se encuentren involucrados todos los actores que forman parte del problema para forjar soluciones adecuadas y coherentes con nuestra realidad y que aseguren una Rehabilitación Integral como un derecho consagrado y garantizado en nuestra Carta Política. Es por ésta razón que este trabajo esboza un posible proyecto de Rehabilitación Integral, en el cual se integran todos los componentes necesarios para una verdadera rehabilitación, así tomamos en cuenta la situación personal y familiar del individuo, el delito cometido, su nivel de educación, su entorno socio económico entre otros para poderle brindar una rehabilitación adecuada y personal. Este Sistema es aplicado únicamente a personas condenadas y establece además un sistema de educación formal y moral, de trabajo y preparación tratando de garantizar que el individuo se reinserte a la sociedad de una manera progresiva, hasta lograr su reinserción total. Todo esto bajo la supervisión de un grupo de profesionales capacitados en rehabilitación social, lo que garantice al Estado Ecuatoriano no sólo la utilización de mano de obra sino que además brinde la oportunidad a las personas privadas de su libertad y a sus familias de educarse y prepararse para un futuro mejor.

The Ecuadorian Penitentiary System is going through a serious institutional and functional crisis, not only due to the lack of a Social Rehabilitation for people deprived of liberty, but mainly due to the lack of criminological policies, consistent with programs and projects of Integral Rehabilitation, until now nonexistent. The authorities for many years have ignored the constant protests generated by this situation, even leading to riots and deaths of inmates due to the lack of guarantees and services in the different Penitentiaries of the country. They have even been part of the problem by not generating effective solutions to overcome this great evil of the Ecuadorian State. It is for this reason that the current government has declared the "State of Emergency of the Penitentiary System" creating institutions such as the Ministry of Justice and Human Rights responsible for creating plans and projects that generate solutions to the problems caused. The former Garcia Moreno Garci'a is a Center of Social Rehabilitation in which the emergent situation indicated before is reflected, it is possible to be observed clearly the problems like the prison overcrowding, the excessive consumption of drugs and alcohol on the part of the interns, the lack of work , equation, health and dignified living conditions for inmates as well as poor institutional management. The staff that make up the Center are deficient and very unprofessional and the high levels of corruption and social inequality are clearly visible. The promiscuity reaches alarming levels and the high levels of respiratory, stomach and venereal diseases allow observing a lack of attention of the authorities towards this vulnerable sector of the Ecuadorian population. vii All these problems make this Center a place that does not generate Rehabilitation but rather more violence and high levels of recidivism, which leads to greater overcrowding and an aggravation of the aforementioned difficulties, as well as a higher level of delinquency in society. It is not easy to generate solutions in the short or long term, but it is necessary to create programs in which all the actors that are part of the problem are involved to forge adequate and coherent solutions with our reality and that ensure Integral Rehabilitation as a right enshrined and Guaranteed in our Political Letter. It is for this reason that this work outlines a possible project of Integral Rehabilitation, in which all the components necessary for a true rehabilitation are integrated, thus we take into account the personal and family situation of the individual, the crime committed, his level of education, their socio-economic environment among others to be able to provide adequate and personal rehabilitation. This system is applied only to convicted persons and also establishes a system of formal and moral education, of work and preparation, trying to guarantee that the individual reinsertes himself to society in a progressive manner, until achieving his total reintegration. All this under the supervision of a group of professionals trained in social rehabilitation, which guarantees the Ecuadorian State not only the use of labor but also provides the opportunity for people deprived of their freedom and their families to educate themselves and prepare for A better future.
