Abstract: En un mundo en que las relaciones comerciales han roto con las barreras limitativas de los contratos tradicionales para ir màsmás allàallá y evolucionar en figuras que pertenecen a un novìsimonovísimo sistema de contratación más ágil y dinámico, han surgido variantes que por sus particularidades se convierten en nuevas y diversas formas de contratación, las cuales por su actualidad y precisión con la realidad se encuentran definitivamente en boga, pero que a la vez interactúan con algunas cada vez más lejanas y caducastradicionales formas de contratación debido a lo cual, las personas ligadas a este bastísimo campo (abogados, empresarios, intermediarios, jueces, etc.) se encuentran muchas veces en la imposiblidadimposibilidad de una correcta utilización, redacción, interpretación, lo cual lógicamente deriva en una equivocada aplicación de normas con las correspondientes controversias que estae situación conlleva. Este tema objeto del trabajo realizado merece un estudio específico, tanto desde su orígenorigen en el desarrollo y evolución de las relaciones contractuales y comerciales, como en la necesidad de realizar ciertas precisiones sobre no solo su figura particular sino también sobre el géeneroérico que son los contratos de distribución para definir por medio de ello la legislación vigente más beneficiosa para su aplicación, en base a las razones antes mencionadas; por ello, principalmente he centrado el desarrollo de este trabajo de investigación en comprobar su calidad de variante del contrato de distribución, desenmarcarlo dedistinguirlo dentro de la clasificación contractual general y establecer su naturaleza.
In a world in which commercial relations have broken with the limiting barriers of traditional contracts to go further and evolve into figures that belong to a new, more agile and dynamic contracting system, variants have emerged that, due to their particularities, become new and diverse forms of hiring, which due to their actuality and accuracy with reality are definitely in vogue, but at the same time interact with some increasingly distant and outdated traditional hiring forms due to which, people linked to this very important field (lawyers, businessmen, intermediaries, judges, etc.) are often in the impossibility impossibility of proper use, drafting, interpretation, which logically results in a misapplication of rules with the corresponding controversies that this situation entails. This subject matter of the work deserves a specific study, both from its original origin in the development and evolution of contractual and commercial relations, as well as in the need to make certain precisions about not only its particular figure but also about the gender that are the contracts of distribution to define by means of it the most beneficial current legislation for its application, based on the aforementioned reasons; for this reason, I have mainly focused the development of this research work in checking its quality as a variant of the distribution contract, unmarking it from the general contractual classification and establishing its nature.
