dc.description.abstractLa presente Tesis, ha sido el resultado de un análisis minucioso, de la adopción como institución de derecho de familia, desde su nacimiento, hasta nuestros días. Empezando por los antecedentes de la adopción de menores en el mundo, especificando como nace y se mantiene esta famosa institución, en las principales legislaciones, destacando entre estas a la romana, en la cual se tiene un procedimiento eminentemente formalista y la francesa, quien a través de la difusión del Código Napoleónico convierte a esta figura en una fuente importante de interés general. Se ha determinado una breve síntesis de la aplicación de la adopción a nivel latinoamericano, con el fin de poder facilitar la comprensión del estudio de la historia, de esta figura en nuestro país, profundizando, el tema, en mención con el análisis de los diferentes cuerpos legales que han regido a través del tiempo en la legislación ecuatoriana, los cuales son el Código Civil, y el Código de Menores, aplicando dicho conocimiento en un caso práctico de adopción de menores, proporcionado por el ex Tribunal Primero de Menores de Pichincha. Para llegar a la parte medular de este trabajo, fue necesario, consultar varias fuentes tanto bibliográficas como virtuales, y visitar, importantes instituciones encargadas del procedimiento administrativo-técnico y judicial de la adopción de niños y adolescentes, como el Ministerio de Relaciones Exteriores, la Unidad Técnica de Adopciones, los Juzgados de la Niñez y Adolescencia, y el Albergue San Juan de Paúl, con el fin de llegar a establecer, una comparación del Procedimiento de la adopción, entre el Código de Menores de 1992 ya derogado y el Código de la Niñez y Adolescencia, que fue publicado, mediante Registro Oficial, de fecha 03 de enero del 2003, y entró en vigencia el 3 de julio del mismo año. Siendo la legislación internacional, la base de la adopción de niños, niñas y adolescentes, se determinaron, los instrumentos internacionales de mayor importancia en esta materia, y su aplicación en la legislación ecuatoriana con el fin de descubrir sus falencias.es_ES
dc.description.abstractThis Thesis has been the result of a thorough analysis of the adoption as an institution of family law, from birth, to our days. Beginning with the antecedents of the adoption of minors in the world, specifying how this famous institution is born and maintained, in the main legislations, emphasizing among these the Roman, in which there is an eminently formalistic procedure and the French, who Through the dissemination of the Napoleonic Code, this figure becomes an important source of general interest. A brief synthesis of the application of the Latin American adoption has been determined, in order to facilitate the understanding of the study of the history, of this figure in our country, deepening, the subject, in mention with the analysis of the different legal bodies that have governed over time in the Ecuadorian legislation, which are the Civil Code, and the Minors Code, applying this knowledge in a practical case of adoption of minors, provided by the former First Court of Minors of Pichincha. To get to the core of this work, it was necessary to consult several bibliographical and virtual sources, and to visit important institutions responsible for the administrative-technical and judicial procedure for the adoption of children and adolescents, such as the Ministry of Foreign Affairs, Adoption Technical Unit, the Courts for Children and Adolescents, and the San Juan de Paul Shelter, in order to establish, a comparison of the Adoption Procedure, between the Child Code of 1992 already repealed and the Code of Childhood and Adolescence, which was published through the Official Registry, dated January 3, 2003, and became effective on July 3 of the same year. Being international legislation, the basis of the adoption of children and adolescents, the most important international instruments in this matter were determined, and their application in the Ecuadorian legislation in order to discover their shortcomings.-
