Problemática de la persona jurídica para demandar daño moral

Abstract

Entendemos que daño moral es aquel agravio implicado con la violación de alguno de los derechos personalísimos así como la paz, la tranquilidad de espíritu, la vida, o el derecho de privacidad, la libertad individual, la integridad física, el honor, la honra de la persona etc. Según esta apreciación sólo las personas naturales serían legitimadas para demandar daño moral puesto que son capaces de sentir dolor, afectación a su dignidad, y ver de una u otra forma lesionados sus derechos personalísimos. Sin embargo, existen autores que afirman que una persona jurídica sí puede sufrir daño moral como resultado de la competencia desleal y daños de otra, cuando con sus acciones, lesiona la imagen, el buen nombre comercial y su posición en el mercado. Según nuestra legislación la persona jurídica es susceptible de sufrir daño moral y por tal motivo está totalmente legitimada para demandar la reparación de daños morales. El presente trabajo investigativo está orientado a desarrollar los diferentes pensamientos doctrinarios y jurisprudenciales respecto de si una persona jurídica puede ser susceptible de sufrir daño moral, y en tal virtud, demandar su reparación.

We understand that moral damage is that offense involved with the violation of some of the most personal rights as well as peace, tranquility of spirit, life, or the right of privacy, individual freedom, physical integrity, honor, honor of the person etc. According to this assessment, only natural persons would be entitled to demand moral damage because they are capable of feeling pain, affecting their dignity, and seeing their personal rights in one way or another. However, there are authors who claim that a legal entity can suffer moral damage as a result of unfair competition and damages of another, when with their actions, it damages the image, the good commercial name and its position in the market. According to our legislation, the legal entity is liable to suffer moral damages and for this reason is fully entitled to demand compensation for moral damages. The present investigative work is aimed at developing the different doctrinal and jurisprudential thoughts on whether a legal entity may be susceptible to suffer moral damage, and in such virtue, demand its reparation.
