Abstract: La compraventa internacional a lo largo de su vigencia económica , estratégica y política no ha tenido la debida justificación legal que la fundamente eso puede apreciarse en lo referente a su formación, aceptación de mercaderías, fijación de precio, riesgo, y principalmente en lo referente a incumplimientos y reclamaciones que pueden conducir al pago de daños y perjuicios, intereses, resolución del contrato ect. Esta actividad ha estado normada por múltiples fuentes como la consuetudinaria, la arbitral, la convencional, que en su conjunto integran los llamados principios del comercio internacional. Estás no son de aceptación universal ya que los principios legales de comercio exterior no forman parte de las legislaciones internas, o estas a su vez son incompatibles por inspirarse en distintos principios del derecho internacional o usos generalmente aceptados al respecto. Por medio de tratados Internacional se intenta brindar pautas jurídicas que permitan el desarrollo y eficiencia de esta actividad. En la actualidad existen nuevas formas contractuales influenciadas por el avance de la técnica y por la coexistencia de diversos sistemas jurídicos.
The international sale through its economic, strategic and political validity has not had the due legal justification that the foundation can be seen in terms of its formation, acceptance of merchandise, price fixing, risk, and mainly in relation to breaches and claims that may lead to the payment of damages, interests, termination of the contract ect. This activity has been regulated by multiple sources such as customary, arbitral, conventional, which together make up the so-called principles of international trade. These are not universally accepted since the legal principles of foreign trade do not form part of the internal legislations, or these in turn are incompatible because they are inspired by different principles of international law or generally accepted uses in this regard. Through international treaties it is tried to provide legal guidelines that allow the development and efficiency of this activity. At present, there are new contractual forms influenced by the advancement of technology and the coexistence of different legal systems.
