Abstract: Dentro del campo del Derecho Internacional Privado, encontramos al fenómeno migratorio como un movimiento de personas a una región o país determinado. Durante los últimos años, el tema de la migración se ha priorizado y a la vez ha sido motivo de comentarios especializados y eventos políticos, académicos y sociales relevantes; así como de la preocupación generalizada de la población. Al ser aprobado por el Parlamento Europeo, la necesidad de una visa para entrar en su territorio, es de suma importancia establecer las políticas que utiliza la Unión Europea para ser aplicadas en sus países miembros en el aspecto relativo a los extranjeros que desean establecerse en este sector. Los emigrantes desconocen de los beneficios que acarrearían una migración legal a estos destinos europeos, decidiendo hacerlo de una manera ilegítima, que en un futuro les traerá problemas de estabilidad, terminado en la deportación y aún peor en la cárcel. Existen distintas modos de establecerse en un país europeo sin la necesidad de pasar por los problemas de residir irregularmente, ya que hay distintas formas de quedarse en esta región de una manera acertada. ¿Sería conveniente establecer los medios idóneos para la correcta emigración de ciudadanos ecuatorianos, para que dentro de la Comunidad Europea sean respetados sus derechos y se establezcan sus garantías y deberes? Esa fue la pregunta que fue el inicio de todo este trabajo investigativo ya que la inmigración se va a convertir en el eje básico de la política exterior europea. La lucha contra el tráfico ilegal de personas es ya una de sus prioridades. Tras haber sido tierra de acogida de inmigrantes, Europa va aprobando políticas de Extranjería cada vez más restrictivas para transformarse en una fortaleza inexpugnable. El fenómeno de migración dentro de la Unión Europea tiene mucho que ver con la declaración de libre circulación de personas de las que la economía sin fronteras de Europa, depende cada vez más para asegurar una oferta flexible de mano de obra tanto cualificada como no especializada.
Within the field of Private International Law, we find the phenomenon of migration as a movement of people to a specific region or country. In recent years, the issue of migration has been prioritized and at the same time has been the subject of specialized commentaries and relevant political, academic and social events; as well as the generalized concern of the population. When approved by the European Parliament, the need for a visa to enter its territory, it is very important to establish the policies that the European Union uses to be applied in its member countries in the aspect related to foreigners who wish to settle in this sector. Migrants are unaware of the benefits that a legal migration would bring to these European destinations, deciding to do so in an illegitimate way, which in the future will bring stability problems, ending in deportation and even worse in prison. There are different ways of settling in a European country without the need to go through the problems of residing irregularly, as there are different ways to stay in this region in a successful way. Would it be convenient to establish the appropriate means for the correct emigration of Ecuadorian citizens, so that within the European Community their rights are respected and their guarantees and duties are established? That was the question that was the beginning of all this investigative work since immigration is going to become the basic axis of European foreign policy. The fight against the illegal trafficking of people is already one of its priorities. After having been a host country for immigrants, Europe is adopting increasingly restrictive immigration policies to become an impregnable fortress. The phenomenon of migration within the European Union has much to do with the declaration of free movement of people of which the economy without borders of Europe, depends more and more to ensure a flexible supply of both qualified and unskilled labor.
