Abstract: En la actualidad, cada día se presentan decenas de reclamaciones laborales, en la mayoría de casos en un 95%, planteadas por los trabajadores, quienes concurren en primera instancia a la Inspección del Trabajo y al tener un resultado poco satisfactorio, se ven en la necesidad de acudir al sistema judicial, mismo que es reconocido por los participantes como un sistema rígido, demoroso y costoso. "En Ecuador sólo el 12% de sus habitantes tienen confianza en la justicia, pues indican que el sistema es corrupto, no es imparcial, es lento y no es efectivo"1. La Constitución Política del Ecuador en el Art. 35, establece que: Será válida la transacción en materia laboral, siempre que no implique renuncia de derechos y se celebre ante autoridad administrativa o juez competente; y reconoce el arbitraje, la mediación y otros procedimientos alternativos para la resolución de conflictos, con sujeción a la ley; en el Art. 191. Mediante el proceso judicial y administrativo se han venido resolviendo los diferentes conflictos laborales con la ninguna o poca aplicación de otros métodos. Con la creación del Centro de Mediación Laboral del Ministerio de Trabajo y Empleo se obtiene la primera experiencia en éste tema; pero el cierre del mismo, la poca divulgación y el desconocimiento de la Mediación como método de solución adecuado han ocasionado su falta de uso. El estudio de este tema y el aporte del mismo es de suma importancia para lograr un mejor ejercicio de los derechos humanos protegidos constitucionalmente y reconocidos internacionalmente como es dar una efectiva solución a los conflictos que se presentan a diario en las relaciones obrero-patronales.
Currently, dozens of labor claims are filed every day, in the majority of cases by 95%, raised by workers, who they attend in the first instance to the Labor Inspectorate and to have a unsatisfactory result, they have to go to the system judicial process, which is recognized by the participants as a system rigid, time consuming and expensive. "In Ecuador only 12% of its inhabitants have trust in justice, because they indicate that the system is corrupt, it is not impartial, is slow and is not effective "1. The Political Constitution of Ecuador in Art. 35, establishes that: It will be valid the transaction in labor matters, provided that it does not imply resignation of rights and is held before an administrative authority or competent judge; Y recognizes arbitration, mediation and other alternative procedures for resolution of conflicts, subject to the law; in Art. 191. Through the judicial and administrative process, the different labor conflicts with no or little application of others methods. With the creation of the Labor Mediation Center of the Ministry of Work and Employment you get the first experience in this subject; but closing of the same, the little disclosure and the ignorance of the Mediation as an adequate solution method they have caused its lack of use. The study of this topic and the contribution of it is of utmost importance for achieve a better exercise of protected human rights constitutionally and internationally recognized as it is to give a effective solution to conflicts that arise daily in relationships worker-employer.
