Migraciones y derechos humanos: una aproximación de la realidad jurídica de las relaciones Ecuador - España

Abstract

El tema de la migración es un tema de ayer, hoy y mañana, porque forma parte de la historia de la humanidad y ésta no se podrá desprender de aquella. Pese a que la migración ha estado presente siempre, estos últimos años en nuestro país se ha convertido en un fenómeno qué ha afectado a todos gracias a la crisis. Siendo así, un tema de trascendental importancia en nuestra sociedad de hoy, he decidido investigar sobre el tema y presentarlo como mi tesis doctoral. Desde el primer momento me identifiqué con el tema por ser hispano - ecuatoriana, esta condición me ha permitido conocer los dos mundos: el viejo y el nuevo, he tenido oportunidad de vivir con su gente, conocer su cultura y por tanto, veo el tema desde los dos escenarios. A diario nos encontramos con varias personas que tienen familiares en el extranjero, a unos les va bien y a otros no como quisieran; el hecho de escuchar constantemente en la calle hace que nos permeabilicemos de esos asuntos. Conversando con la gente, conocemos de mejor manera las causas que llevan a que se decidan dejar todo y buscar un futuro mejor, también se aprende cuando alguien que lo ha pasado mal cuenta sus experiencias. No cabe duda que también el bombardeo de los medios de comunicación, respecto de la migración, me ayudaron a decidir por ese tema, para ver el grado de veracidad y constatar si realmente llegan a la médula del problema. El tema de la migración es fascinante por cuanto no tiene límites, es decir, se puede retroceder en la Historia y acompañar grandes sucesos que han ocurrido gracias a que la gente se ha decidido a migrar. Además, la migración, al ser un amplio tema, no debe ser visto únicamente desde una óptica, sino que para comprenderlo debe estudiárselo desde el punto de vista social, económico, político, jurídico y cultural. Con cada uno de ellos tiene mucho que ver, por ejemplo con lo social, existen muchas facetas pero lo que a mí más me preocupa es la desintegración de las familias y el hecho de que adolescentes, sin ninguna advertencia ni preparación, tienen que hacerse cargo del hogar, convirtiéndose, sin quererlo, en jefes de familia. En lo económico, si los gobiernos se preocupasen y lograsen crear el "Estado de Bienestar", su gente no necesitaría salir de sus tierras, dejar sus familias, amigos, entorno porque no anhelarían nada; por supuesto que esto resulta una utopía porque ningún país hasta la presente fecha ha logrado que todos sus habitantes alcancen todo lo que desean y por tanto no se vean en la necesidad de migrar; pero, al menos los gobiernos deben esforzarse por crear las condiciones mínimas de bienestar para que la gente no se desespere por cosas tan elementales como obtener un empleo que le permita vivir con dignidad, contar con servicio de salud estatal de buena calidad, gozar de educación realmente gratuita y de calidad. En lo político, desgraciadamente sólo cuando la migración se convierte en un asunto de importancia por el volumen de gente a la que afecta, allí se preocupan tanto los gobiernos receptores como los gobiernos emisores. Los gobiernos emisores porque pueden llegar a ver en ellos una fuerza electoral y principalmente económica con el aporte de las remesas; y los gobiernos receptores se preocupan porque puede ser tal el número de inmigrantes que ponga en peligro la estabilidad económica y provoquen movimientos xenófobos e intolerantes.El plano jurídico tiene mucho que ver, desde dos puntos de vista: el interno y el internacional. Es necesario que los Estados revisen sus leyes nacionales y adopten principios y políticas que estén acordes con la realidad. En el ámbito internacional, existen diverso Convenios, Tratados, Conferencias pero aún así, hoy en día un migrante sufre violaciones de sus derechos y esto indica que no hace falta tratar más en papel el tema sino educar a la población, tanto a las personas que viven en los países receptores como a los migrantes. A las personas que viven en los países receptores hacerles ver que los migrantes no salen de su país por elección propia sino por presión de las circunstancias y que ellos no desean ocasionar problemas sino tan sólo poder rehacer su vida.

Politically, unfortunately only when migration becomes an issue important for the volume of people affected, there are so much concern recipient governments as the issuing governments. The issuing governments because they can see in them an electoral and mainly economic force with the contribution of remittances; and recipient governments worry because it can be such the number of immigrants that jeopardize economic stability and provoke xenophobic and intolerant movements. The legal level has much to do, from two points of view: the internal and the international. It is necessary for States to review their national laws and adopt principles and policies that are in accordance with reality. To the people who live in the countries recipients to see that migrants do not leave their country by their own choice but by pressure of circumstances and that they do not want to cause problems but so I can only redo his life.
