Abstract: | La ciencia jurídica, dada su concepción angular y protagónica en la historia de las
sociedades, es la pieza cardinal de las relaciones de sus integrantes, de ahí que su
marcada originalidad derive en una constante reafirmación y adaptación a las
múltiples y cambiantes necesidades del ser humano y de la comunidad en general,
significación por demás precisa para fijar que la democracia de los pueblos ha sido
concebida sobre la base del derecho, y cuyas raíces no son una verdad inmutable,
sino al contrario, un instrumento retocado por aciertos y errores, por demás
aleccionadores, en una búsqueda constante por alcanzar sus ideales de justicia y
equidad.
En el ámbito mercantil, la legislación normativa de la competencia es uno de los
contenidos jurídicos que mayor impulso ha recibido, especialmente durante el
siglo XX, dada la evolución y aparición de mercados desarrollados y economías
industrializadas, modernas y eficientes. En esa línea y para que el modelo
adoptado funcione de manera eficiente, es imprescindible que se garanticen
derechos fundamentales, tales como, propiedad privada, libertad de empresa,
iniciativa privada, libertad de asociación, entre otros, brindando la posibilidad de
participar activamente en un mercado, por un lado, ofertando bienes y servicios de
calidad, y por otro lado, demandando libre y voluntariamente, en condiciones de
competencia. Legal science, given its angular and protagónica conception in the history of the societies, is the cardinal piece of relations of its members, hence its marked originality derive in a constant reaffirmation and adaptation to multiple and changing needs of the human being and the community in general, very precise significance to establish that the democracy of the peoples has been conceived on the basis of law, and whose roots are not an immutable truth, but on the contrary, an instrument retouched by successes and errors, otherwise educators, in a constant search to reach their ideals of justice and equity. In the commercial sphere, the regulatory legislation of competition is one of the legal content that has received the most boost, especially during the twentieth century, given the evolution and emergence of developed markets and economies industrialized, modern and efficient. In that line and so that the model adopted function efficiently, it is imperative that they be guaranteed fundamental rights, such as, private property, freedom of enterprise, private initiative, freedom of association, among others, offering the possibility of actively participate in a market, on the one hand, offering goods and services of quality, and on the other hand, by claiming freely and voluntarily, in conditions of competition. |
