Abstract: | La presente tesis aborda el tema de "LA
PRESCRIPCION COMO FORMA DE EXTINGUIR LA OBLIGACION
TRIBUTARIA". ;
La prescripción es una forma de extinguir las
obligaciones por el transcurso del tiempo, sin
embargo, ésta no opera de pleno derecho ni se
cumple ipso-facto. tal es el principio juridico
que se aplica a todos los ámbitos y materias del
Derecho.
Sin embargo, en materia de Derecho Tributario,
se impuso en el país la política de disponer
oficiosamente la prescripción de las obligaciones
tributarias, por «paarrttee daee los tribunales
competentes.
Esta ha sido una arrogación de funciones y de
atributos jurídicos por parte de los Tribunales
Fiscales, que ha perjudicado la justas relaciones
entre la Administración Tributaria y los
contribuyentes o responsables, como sujetos pasivos
del tributo, y, en última instancia, ha perjudicado
los intereses fiscales del Estado.
