Abstract: | Cuando una pareja se divorcia, en general después de un largo período de
desilusiones, intentos de mejorar la relación, etc, se produce un sentimiento de
fracaso y pérdida de la autoestima; desajustes de conducta, como si la persona
hubiera perdido la coherencia que tenía antes del divorcio.
De modo que el conflicto que se presenta es legal, social y psicológico, entre
otros factores. Sin embargo, hay un amplio margen desde lo legal para considerar el
divorcio, puede ser controvertido o por mutuo consentimiento; si hay hijos, se fijarán
alimentos, se decidirá quién se hará cargo de la tenencia, se fijará el domicilio. Pero
también se presentan una serie de conflictos psicológicos y sociales, no siempre
tenidos en cuenta y que a la larga serán los que definirán la duración del pleito.
La experiencia muestra que en muchos casos en que se decidió un común
acuerdo "formal", para apurar el trámite y lograr una pronta sentencia, duran poco.
Es necesario detenerse a reflexionar sobre el dolor, la frustración; asumir que se
eligió a esta persona en un momento determinado de la vida y el hecho de no poder
cumplir con el "mandato" para toda la vida, es responsabilidad de ambos miembros
de la pareja, aunque sea por distintos motivos.
La mediación surge como una técnica de resolución de conflictos en la que
un experto tratará de ayudar a dos personas bienintencionadas a buscar puntos en
común para poder lograr acuerdos que se comprometerán a cumplir, sin la
intervención de terceros.
El divorcio es una situación conflictiva; el conflicto es algo universal; no existe
desde el punto de vista psicológico, individuo sin conflictos. El conflicto no es bueno
ni malo, cómo se lo maneja puede ser mejor o peor. La función constructiva de un
conflicto es ayudar al cambio. Llegar a compromisos implica una resolución del
conflicto, puesto que satisface a ambas partes, que son capaces de perder algo,
para ganar algo distinto que en situaciones anteriores. Tratar de lograr algo más que
la mera resolución por compromiso, sería lograr una actitud de colaboración.
