Aplicación de medidas cautelares de acuerdo a la ley de arbitraje y mediación

Abstract

El presente trabajo de investigación pretende realizar un estudio profundo y minucioso sobre las facultades jurídicas que tiene el Tribunal Arbitral dentro de un proceso de arbitraje para dictar medidas cautelares y éste a su vez la problemática de no poder ejecutarlas dentro del mismo arbitraje, sino mas bien que las partes deban acudir a la justicia ordinaria a fin de poder ejecutar el laudo arbitral que fue producto de un convenio hetecompositivo. Desencanto el que, permite analizar partiendo de esta perspectiva qué tan efectivo sería que el Tribunal Arbitral pueda ejecutar o no, las medias cautelares ordenas por ellos mismos sin necesidad de acudir a la justicia ordinaria, así como también si antes de que se instale el Tribunal se determine si tiene o no tiene la facultad de ordenar medidas preventivas o se requiere de la justicia ordinaria para llevarlas a cabo.

This research work aims to conduct a thorough and thorough study of the legal powers of the Arbitral Tribunal in an arbitration process to issue precautionary measures and this in turn the problem of not being able to execute them within the same arbitration, but rather that the parties must go to the ordinary courts in order to be able to execute the arbitral award that was the product of a hetecompositive agreement. Disenchantment that, allows analyzing from this perspective how effective it would be that the Arbitral Tribunal can execute or not, the precautionary measures ordered by themselves without having to go to the ordinary courts, as well as before the Court is installed it is determined whether or not it has the power to order preventive measures or the ordinary justice is required to carry them out.
