El reconocimiento del proyecto de vida de la víctima en el código orgánico integral penal

Abstract

El presente trabajo de investigación tiene como objetivo primordial estudiar la importancia del Proyecto de Vida, que ha sido incluido en las sentencias emitidas por la Corte Interamericana de Derechos Humanos, para resarcir el daño moral o físico de las víctimas de los delitos violentos o culposos ajenos a la voluntad de las personas, el Ecuador no ha incluido en el Código Orgánico Integral Penal el Proyecto de vida, causando indefensión así también inseguridad jurídica, en afectación a la víctima en su desarrollo y realización integral, como vocación, aptitudes, circunstancias, potenciales y aspiraciones, cuando no existe la reparación del daño causado.

The main objective of this research work is to study the importance of the Life Project, which has been included in the sentences issued by the Inter-American Court of Human Rights, to compensate the moral or physical damage of the victims of violent or negligent crimes of others. to the will of the people, Ecuador has not included in the Organic Comprehensive Criminal Code the Life Project, thus causing legal uncertainty, in addition to the victim in its development and integral realization, as a vocation, aptitudes, circumstances, potential and aspirations, when there is no repair of the damage caused.
