Implementación en el Ecuador de la disolución del vínculo matrimonial por mutuo consentimiento en notarías cuando existen hijos menores de edad

Abstract

En la actualidad en el Ecuador la disolución del vínculo matrimonial se ha manejado de manera judicial, desde la reforma a la Ley Notarial de 2006 se ha dado la posibilidad de que los notarios también tengan la potestad de divorciar por mutuo consentimiento, pero únicamente en casos en los que la pareja no tenga hijos menores de edad (Art. 19 numeral 22). El objetivo del presente trabajo de fin de carrera es comprobar si existe la posibilidad de poder adoptar en nuestra legislación la facultad que contempla la legislación Colombiana en la que se admite el divorcio notarial cuando existen hijos menores de edad siempre y cuando se garantice el bienestar de los mismos, o sería factible seguir el ejemplo español en donde esto no se admite.

Currently in Ecuador the dissolution of the marriage bond has been handled in a judicial manner, since the reform of the Notarial Law of 2006 has given the possibility that notaries also have the power to divorce by mutual consent, but only in cases in which the couple has no children under age (Art. 19 numeral 22). The objective of the present thesis is to verify if there is the possibility of adopting in our legislation the faculty that contemplates the Colombian legislation in which the notarial divorce is admitted when there are minor children as long as the welfare of the children is guaranteed. the same, or it would be feasible to follow the Spanish example where this is not admitted.
